The Data Behind the Prediction Market Injunction: A Temporary Relief or a Structural Shift?

The catalyst was a single federal court order: a temporary injunction blocking Minnesota’s enforcement of a law that criminalizes prediction markets. At first glance, this looks like a clear win for Kalshi and Polymarket. But the data beneath the surface reveals a more fragile reality. The context is a regulatory gridlock. Minnesota’s 2024 statute defines prediction markets as illegal gambling, carrying felony penalties. The law was set to take effect August 1, threatening to shut down operations for any platform serving state residents. Kalshi and the U.S. arm of Polymarket—both registered with the CFTC—filed a joint motion arguing federal preemption under the Commodity Exchange Act.
